The plaintiff and the defendant entered into a contract on July 19,1948, to purchase certain real property upon which the defendant was to construct a building in accordance with certain plans and specifications. On May 16, 1949, the plaintiff instituted an action against the defendant containing two counts predicated upon fraud. The “ wherefore ” clause sought the rescission of the contract, the payment with interest of $19,750 which the plaintiff had paid to the defendant, the additional sum of $10,000 as damages, and that6 ‘ Plaintiff have such other and further relief as to this Court may…
