Appeal by the defendant, John E. Teiper, from a judgment of the Supreme Court, Erie county, rendered against him on the 22d day of December, 1916, convicting him of the crime of murder in the second degree, and also from an order of said court made on the 5th day of January, 1917, denying defendant’s motion for a new trial made upon the minutes.

Kruse, P. J.:

About eleven o’clock on a Sunday night in January, three years ago, the defendant, a young man of good repute, left his home with his mother, brother and sister in his mother’s automobile and shortly thereafter the mother and brother were found dead and the sister unconscious and so seriously injured that she has lost all memory of any of the circumstances in connection with the tragedy.
