delivered the opinion of the Court.

This is the second appeal to this court from judgment for the defendant in an action on the case for deceit by way of alleged fraudulent representations in respect to a house sold by the defendant to the plaintiff.

There was, upon the trial from the judgment in which this appeal is prosecuted much evidence tending to show that the defendant did willfully and fraudulently deceive the plaintiff as to the character of the house, and that appellant was damnified thereby.
