OPINION AND ORDER

BERTELSMAN, Chief Judge:

Plaintiffs initiated this civil rights action pursuant to 42 U.S.C. § 1983. Alford T. Ford, Jr., plaintiffs’ son, sustained a fatal gunshot wound during an arrest. Mr. and Mrs. Ford allege claims both individually and on behalf of the decedent’s estate. This matter is before the court for consideration of defendants’ motions to dismiss (doc. # 10, # 15 and # 17).
