OPINION AND ORDER

The court, in its Opinion and Order at Docket No. 57 granted in part and denied in part Wyndham’s Motion for Summary Judgment at Docket No. 27. An issue was raised on the Pretrial/Settlement Conference held on December 11, 2013. Plaintiff asserted that his claim for damages as a result of the alleged constructive discharge claim was still alive. Defendants, on the other hand, alleged the claim was disposed of with the partial summary judgment. This court moved the parties to clarify this *160issue. (See Docket No. 65.)
