This matter comes on in the form of a petition for a writ of mandate whereby we are asked to direct the Judge of the Montgomery Circuit Court to enter.a final judgment in a cause entitled Fred L. Clark, Ina L. Clark, plaintiffs, vs. Virgil R. Richardson, John Sams, Ethel Sams, defendants, and numbered 27,326 in that court.
