Seewald, J.), rendered December 3, 2003, convicting defendant, after a jury trial, of murder in the second degree and petit larceny, and sentencing him to an aggregate term of 22 years to life, unanimously modified, on the law and the facts, to the extent of reducing the murder conviction to manslaughter in the second degree and remanding for resentencing on that conviction, and also modified, on the law, to the extent of vacating the DNA databank fee, and otherwise affirmed.
