Appeal from District Court, Third District; Hon. T. ID. Lewis, Judge. Thomas Riley was convicted of murder and he appeals.

The defendant, Thomas Riley, was informed against in the district court of Salt Late County for the murder of one George W. Fassell on March 26, 1910. A trial was had, and on June 23, 1910, the defendant was found guilty *228as charged, and was sentenced, July 8, 1910, to be executed. From the judgment rendered, the defendant has appealed to this court.

The following terse and lucid statement of the facts leading up to and surrounding the commission of the homicide is taken from the able and exhaustive brief filed by defendant’s counsel in the case.
