OPINION

McDONALD, Chief Justice.

This is an appeal by plaintiff Mourning and intervenor Travelers Insurance Company, from summary judgment that plaintiff take nothing in a personal injury suit against defendants Crown Stevedoring Company and P. D. Marchessini Company.

Plaintiff, an employee of McLeon Industries, was injured on July 12, 1963. He filed a claim for workmen’s compensation and judgment was entered for him against the compensation carrier, Travelers Insurance Company, in January, 1964.
