Stone instituted an action against Minter, administratrix, and Minter, administrator,.of the estate of William S. Minter, making substantially the following case : The intestate died on July 5, 1897, and at the time of his death was in*46debted to petitioner in the principal sum of twent3-three hundred dollars, besides interest.
