Appeal from a judgment of the County Court of Schenectady County, rendered November 29, 1976, upon a verdict convicting defendant of the crimes of rape in the first degree and rape in the second degree. The record establishes beyond any doubt that the adult defendant engaged in sexual intercourse with a 12-year-old girl.
