MEMORANDUM OPINION

This is an action brought pursuant to the Labor-Management Reporting and Disclosure Act (“LMRDA”), 29 U.S.C. §§ 401-531, against Defendant International Longshoremen’s Association (“ILA”). Pending before the Court are Defendant ILA’s Motion For Summary Judgment As To Liability On Plaintiffs’ Remaining Claim (D.I.138) and Plaintiffs’ Cross-Motion For Summary Judgment And For An Order Requiring The ILA To Amend Article XXVII Of The ILA Constitution And For An Award Of Punitive Damages (D.I.145).
