In April 12, 2011, 777 F.Supp.2d 475 (W.D.N.Y.2011), the Court issued a Decision and Order (Dkt. # 62) granting summary judgment in favor of plaintiff Millennium Pipeline Company, L.L.C. (“Millennium”), and finding that Millennium was entitled under the Natural Gas Act, 15 U.S.C. § 717 to a permanent easement in certain real property (“Property”) owned by defendant Nathaniel Hendricks in Chemung County, New York.
