The defendant moves for judgment on the pleadings, consisting of the complaint, answer and reply in a common-law action brought by the plaintiff to recover damages for personal injuries sustained on June 30, 1915. The complaint alleges, among other things, that at the time above mentioned the defendant was “ engaged in the business of a mason and builder, putting down concrete sidewalks, &c., with a principal office for the transaction of business at No. 985 Sixth avenue, in the Borough of Manhattan, New York City, New York,” and the plaintiff was in the employ of the defendant as a common…
