Appeals by the People from (1) an order of the County Court, Suffolk County (Tisch, J.), dated April 8, 1988, which dismissed the indictment against the defendant for lack of legally sufficient evidence, and (2) an order of the same court (Cacciabaudo, J.), dated May 5, 1988, which denied their application pursuant to CPL 190.75 (3) to resubmit the matter to the Grand Jury.

Ordered that the order dated April 8, 1988, is affirmed; and it is further,
