This is an action under the Workmen’s Compensation Act. Claimant was injured on August 10, 1927, by an accident arising out of and in the course of his employment with the defendant, Gille Manufacturing Company, in Kansas City. A claim for compensation was filed with the commission on October 4, 1928. The insurer, which represented itself and the employer in all matters before the • commission, filed an answer-to the claim, setting forth as the sole defense that the statute of limitations had run against the claim.
