OPINION

Spencer WILLIAMS, District Judge:

This litigation has a long and complicated past, much of which is documented in prior opinions from this and other courts.1 To clarify, however, we begin with a brief review of the case’s underlying facts and procedural history.

In 1974, plaintiffs2 sought declaratory and injunctive relief against defendants, contending that application of the California Coastal Zone Conservation Act of 19723 was unconstitutional as applied to them.
