WEISBERGER, Justice.

Linda Gagnon brought this civil action against the State of Rhode Island on her own behalf and on behalf of her daughter Christine Gagnon as her next friend and natural guardian. The complaint alleges injuries suffered as a result of Christine’s having been sexually molested while in a day-care facility negligently supervised by the State of Rhode Island. This case is before us on appeal from a judgment of the Superior Court granting the state’s motion to dismiss the plaintiffs’ complaint pursuant to Rule 12(b)(6) of the Superior Court Rules of Civil Procedure on…
