KLINGEMAN, Justice.

This is a suit for damages by appellee, Lewis Kayton, permanent administrator of the estate of Roy Campbell Booth, against the Frost National Bank for physical loss of the value of improvements to real estate and their contents occurring during Hurricane Celia. The Bank cross-claimed against Kayton for a contribution in the event the Bank should be held to have breached any duty to the estate of Roy Campbell Booth.
