A jury convicted Daniel Vaughn of assault in the first degree, § 565.050, RSMo 1994,2 armed criminal action, § 571.015.1, felonious restraint, § 565.120, burglary in the first degree, § 569.160, attempted sodomy, §§ 564.011 and 566.060, and attempted robbery in the first degree, §§ 564.011 and 569.020. The trial court sentenced him as a persistent offender pursuant to § 558.016.3 to 30 years imprisonment on the count of assault in the first degree, to be served consecutively with 45 years imprisonment on the armed criminal action count.
