LEDERBERG, Justice.

The issue before the Supreme Court is whether the Rhode Island General Assembly violated the equal protection provisions of the Rhode Island and United States Constitutions by enacting legislation 1 that authorized Kevin Kennedy (plaintiff) to bring suit against the State of Rhode Island (defendant) for an amount in excess of the limitation on damages set forth in the Governmental Tort Liability Act.
