OPINION
SULLIVAN, Judge.
The State of Indiana, on the relation of the Indiana Alcoholie Beverage Commission (IABC), commenced this declaratory judgment action on August 7, 1991 naming as defendants Indiana Wholesale Wine and Liquor Company, Inc. (Indiana Wholesale), National Wine and Spirits Corporation (National), and Olinger Distributing Company, Inc. (Olinger). 2 The IABC sought "judicial guidance on the meaning and application of I.C. 7.1-8-21-5, with respect to the Indiana Wholesale Wine & Liquor Company, Inc." Record at 27.
