The defendant, Brian Dennis, was indicted for the rape (two counts) and kidnapping of a woman to whom we will refer in this opinion as “complainant.” After a suppression hearing concerning a disputed videotaped statement that the defendant made, 1 a trial was held. At the conclusion of the trial, the jury convicted the defendant of one count of first-degree sexual assault, while simultaneously acquitting him of the second count of first-degree sexual assault and of the kidnapping charge.
