In an action to recover the amount of tax liens on the *362defendants’ real estate which was paid by the plaintiff, the plaintiff appeals from so much of an order of the Supreme Court, Rockland County (Bergerman, J.), dated June 11, 2002, as denied that branch of its motion which was for summary judgment and granted the defendants’ cross motion for summary judgment dismissing the complaint.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the motion which was for summary judgment is granted, the cross motion is denied, the complaint is reinstated,…
