Appellees were given judgment for $38.10 in the Jefferson circuit'court on an apportionment warrant issued by the city of Louisville to them for reconstructing the side-walk in front of the property of appellant on Breckinridge street, between Hancock and Clay streets. On December 20, 1908, an ordinance regularly passed by both boards of the general council of the city of Louisville, entitled “An ordinance to improve the sidewalk on both sides of Breckinridge street, between Hancock and Clay streets,” was approved and signed by the Mayor.
