MEMORANDUM OPINION AND ORDER
This cause is before the court on the defendants’ motion to dismiss, alleging that the complaint fails to state a claim upon which relief can be granted and that the court lacks jurisdiction over the subject matter of the action. In addition, defendant Elmo D. Roebuck has moved for a dismissal of the action against him, contending that he is not personally liable to the plaintiff.
