This is an appeal from an order confirming a sale of certain premises made pursuant to a mortgage foreclosure, which order was entered on March 21, 1938. Two questions are presented, viz.: (1). A motion filed by appellee, and noticed for hearing, on December. 5, 1938, ,for a. dismissal *631of the appeal for lack of necessary parties in this court; and (2) the alleged error of the trial court in overruling -defendant Grotsie Neverve’s motion to vacate the public sale had because of insufficiency of purchase price.
