Addison v. Duncan

This was an action by W. P. Addison against Richard Duncan and A. J. Clinkscales. The appeal was argued January 8, 1891, before Justices McIver and McGowan, who ordered a re-argument. The reargument was had December 21, 1892. The opinion states the case.

This was an action on a note, and the plaintiff,in his complaint alleged, first, the execution by defendants to the plaintiff of the note sued upon, setting out a copy thereof. Second, “that the plaintiff is still the legal owner and holder thereof, and that no part thereof has been paid, and there is still due and owing thereon” the amount mentioned in the note, with interest at the rate therein stipulated for.
