Appellant was found guilty of contempt of court in keeping a place where intoxicating liquors were sold in violation of an injunction granted by the district court. From a sentence of sixty days in jail and a fine of $300 he appeals.

The judgment in the injunction case was rendered May 27, 1905. Complaint is made that the court should have dismissed the contempt proceedings because no summons was issued in • the original suit.
