This case is here on appeal by both parties now in interest from the action of the chancellor in sustaining in part and overruling in part the demurrer filed by Southern Railway Company.

It is said in the brief filed on behalf of the City of Cleveland that the appeals present many novel questions, upon some of which authority is scant, and upon others, practically non-existent.
