This is a suit in equity to set aside an alleged excessive assessment for State and county taxes made as of June 1, 1937, by the respondent assessor of Buchanan County upon, certain real estate in the city of St. Joseph, described as Lot 1, Block 21, Patee’s Addition. Appellant purchased the property thereafter on September 1, 1938. The trial court sustained respondent’s demurrer to the petition, appellant refused to plead further, and judgment went for respondent.
