The particular facts in this case are important in deciding the issues involved. Warren is a home-rule city and for a number of years its treasurers, without any objection from the city council, determined what investments should be made with temporarily surplus city funds. Finally one treasurer made some extremely questionable and completely inappropriate investments which ended in the city’s losing large sums of money.
