TIMBERS, Circuit Judge:
This is an appeal from an order and judgment entered July 20, 1990 and from an order entered September 14, 1990, in the Western District of New York, David G. Larimer, District Judge, granting all appel-lees’ motions for summary judgment pursuant to Fed.R.Civ.P. 56 and thereafter denying appellant Frank Parsons’ motion for reconsideration pursuant to Rule 59(e).
