PARKER, Circuit Judge.

This is an appeal from a judgment in favor of the plaintiff in an aetion instituted on a policy of fire insurance. A number of defenses were asserted in the court below, but the only one of these presented by the appeal is that proofs of loss were not furnished within the time limited by the policy. This point is raised by ihe exception to the refusal to direct a verdict in favor of the plaintiff and by the exception to the portion of the court’s chai-ge wherein the jury were allowed to consider the question as to whether the proofs of loss had been waived by the…
