This is the second appeal of this case. The first appeal, under the style of DeCharette v. St. Matthews Bank & Trust Co., was decided by this court on May 11, 1926. The opinion may be found in 214 Ky. 400, 283 S. W. 410, where a very clear statement of the issues involved 'and the proceedings had in the litigation up to that time may be found.
