— Puckett sued Everhart & Everhart, on a promissory note, before a justice of the peace; judgment was rendered for the plaintiff; appeal to the circuit court; trial by the- court, and judgment for the plaintiff for the amount of the note and interest; motion for a new trial, by -defendants, overruled and excepted to.

In this court appellants have assigned, as error, the overruling of the motion for a new trial. The motion for a new trial was for the following causes :

“1st. That the decision of the court is not sustained by sufficient evidence;
