The plaintiffs sued to recover damages

aggregating $148,500 alleged to have arisen from the breaking of a levee during the high water period of February, 1936. The three plaintiffs are separate copartnerships each of which holds under a lease from the defendants J. 0. Franks Estate Company and the individual defendants comprising that company. The defendants are all the owners of the entire tract of land comprising an island of about 4,000 acres in the delta region in the old river and slough section of Contra Costa County.
