Appeal from a judgment in an action to determine the title to real property under article 15 of the Real Property Law which determined that the State of New York has the title to the property in question.

The property involved here is the southerly portion of a piece of land generally known as the Big Island and located in the De Ruyter Reservoir. There is a dispute as to whether this land is really an island or a peninsula, it having been shown that it is surrounded on three sides by water but that there is dry land between it and the mainland except in the Spring when this connecting strip…
