Plaintiff was a longshoreman in the employ of defendant Apuzzo, who was a stevedore. While the stevedore was unloading, at the Arbuckle Building, Brooklyn, a cargo of sugar from the vessel O. A. Knudson, which had been chartered by the defendant Munson Steamship Line, under a charter party known as a “ time charter, government form,” plaintiff sustained injuries. He brought action to recover damages, alleging that defendants owed him, among other duties, the duty of inspecting the vessel before putting him at work on it, which they negligently omitted to discharge.
