INTRODUCTION

On August 7,1996, plaintiff Kurt Robinson filed a complaint against the City of Wilmington, the Mayor, the City Council members, and Officers Vincent Clemons and David Simmons, alleging various torts and violations of 42 U.S.C. § 1983 1 arising from an arrest of Robinson that occurred on July 19, 1994. The § 1983 claim was grounded in plaintiffs Fourth Amendment right to be free from unreasonable seizure as well as plaintiffs rights under the Fourteenth Amendment Due Process Clause.
