I. INTRODUCTION

Plaintiff Pennsylvania National Mutual Casualty Insurance Company (“Penn National”) brings this action seeking a declaration of its rights and duties under two insurance policies issued to Defendant HVAC, Inc. (“HVAC”). As a preliminary matter, the Court has not yet addressed whether it will exercise jurisdiction over this declaratory judgment action.
