The defendant was indicted with his brother Peter Barrett in the district court for Hennepin county for the murder of Thomas Tollefson on July 27,1887, in the city of Minneapolis. Defendant, having demanded it, was allowed a separate trial, was tried before Lochren, J., and a jury, was convicted of the crime of murder in the first degree, and was sentenced to be hanged. The defendant, indicted for the crime of murder in the first degree, jointly with his brother Peter, having obtained a separate trial, was found guilty of the offence charged.
