Plaintiff almond growers, handlers, and grower-handlers in the State of California bring this action pursuant to the Agricultural Marketing Agreement Act of 1937 (“AMAA”), 7 U.S.C. § 601 et seq., and the Administrative Procedure Act (“APA”), 5 U.S.C. § 706, against the Secretary of the United States Department of Agriculture (“USDA”) to challenge a USDA regulation requiring almond handlers to treat raw almonds in order to reduce the risk of Salmonella bacteria contamination.
