SHELBOURNE, Chief Judge.

This case was tried to the Court Januáry 3,1955, January 10,1955 and March 28, 1955, on which latter date the evidence was completed.

The suit arose out of the termination in December 1952 of the employment of the plaintiff Bell, a route salesman for defendant, Jewel Tea Company, Inc., as the result of alleged shortages in his accounts. Bell had a contract of employment which provided that all materials and goods delivered to a storeroom near the neighborhood in which Bell’s route was located, remained the property of the defendant company, with the responsibility for…
