¶1 Donna Thornton, a resident of Flathead County, Montana, suec Jay Deist (Deist), also a Flathead County resident, in the United States District Court in Missoula, Montana, claiming Deist had committed various federal crimes causing her injury. The federal court ruled in favor of Deist and dismissed Thornton’s action. Deist then brought a malicious prosecution claim against Thornton and Thorco, a Montana corporation of which Thornton is an officer, in the Fourth Judicial District Court, also in Missoula.
