Plaintiff Daveri Development Group, LLC (“Daveri”) submitted an application to the Defendant Village of Wheeling (“Wheeling”) to obtain zoning approval for an apartment building for individuals with mental disabilities who are capable of living independently. Wheeling denied the application citing zoning concerns.
