Mario Trujillo appeals from a jury conviction on aggravated battery of a law enforcement officer (K.S.A. 21-3415).

The evidence at the trial indicates that appellant was observed one evening striking a beer bottle against new cars as he passed through a car lot of an automobile dealership. Diane Charles, an employee of the dealer, testified that she observed appellant striking the cars as he was “staggering all over the place.” Miss Charles asked one of the car salesmen to call the police.
