The defendant John Whistnant was charged with robbery in the first degree in violation of Public Acts 1975, No. 75-411, %1 (a) (2), now General Statutes § 53a-134 (a) (2), 1 larceny in the third degree in violation of General Statutes § 53a-124 (a) (l), 2 and carrying a pistol without a permit in violation of General Statutes §§ 29-35 and 29-37. 3 He pleaded not guilty and elected to be tried by a jury of six.
