Memorandum of Decision

Before me on a stipulated record is MC. Schtick’s [hereinafter “ScMnek”] motion for relief from stay. Schinck seeks relief so that he, as foreclosing mortgagee, may cause the sheriff to evict Chapter 13 debtors, Daniel and Donna Stephens [hereinafter “Stephens-es”] from their residence, the mortgaged premises. For the reasons set forth below, I conclude that relief from stay will issue. 1
