Appeal from Emmet District Court. — Hon. A. D. Bailie, Judge. Proceeding for divorce upon the grounds of cruel and inhuman treatment and adultery. Decree was entered in favor of plaintiff, and appeal is taken by the defendant.

I. This is a proceeding for a divorce tried upon the issues raised by the charge, in the petition of the husband, of cruel and inhuman treatment by the wife, a like charge of cruel and inhuman treatment made by the wife against her husband in a cross-petition, and the charge of adultery by the wife with one Fred Ruckman, made in an amendment to the petition, which was filed after the answer and cross-petition.
